1. Who we are

These terms and conditions apply to all purchases made by consumers on valvelle.com (the "Shop").

In these terms, "we", "us" and "our" refer to the seller named above, and "you" refers to the customer.

2. Scope

2.1 These terms apply to every offer on the Shop and to every contract concluded between you and us through the Shop.

2.2 The Shop is intended for consumers, meaning natural persons acting for purposes outside their trade, business, craft or profession, with a delivery address in Ireland, Austria, France, Luxembourg, Italy, Spain or Portugal (see our Shipping Policy for excluded regions).

2.3 Nothing in these terms limits the rights you have under the mandatory consumer protection law of the country in which you have your habitual residence.

2.4 These terms are available in English, French, German, Italian, Spanish and Portuguese. The contract is concluded in the language of the version of the Shop you use to place your order. You can save and print these terms at any time; we also send them to you with your order confirmation.

3. Products and prices

3.1 We describe our products (coffee tables with tempered glass, wall mirrors and artificial plants) as accurately as possible. Photographs are illustrations; small differences in colour, wood grain and finish are a natural characteristic of wood and of screen display and do not constitute a defect, unless they affect the agreed characteristics of the product.

3.2 All prices are in euro (EUR) and include the VAT applicable in the country of delivery. Delivery to the countries listed in clause 2.2 is free of charge. There are no other additional costs, unless clearly stated before you place your order.

3.3 If a price is shown as reduced, the reference price is the lowest price we charged for that product in the 30 days before the reduction.

3.4 Obvious errors in prices or product information (for example a price of EUR 1 instead of EUR 100) do not bind us, provided we inform you as soon as possible. In that case you may choose to buy at the correct price or to cancel the order free of charge; any amount already paid is refunded in full.

4. Ordering and conclusion of the contract

4.1 The product presentation in the Shop is an invitation to you to place an order, not a binding offer.

4.2 You place an order by going through the checkout steps: selecting products, entering your delivery and contact details, choosing a payment method, checking the order summary (where you can correct any input errors), and clicking the button "Pay now" (or an equivalent button that clearly indicates that the order involves an obligation to pay). By doing so you make a binding offer to purchase.

4.3 The contract is concluded when we send you the order confirmation by e-mail. The order confirmation contains the essential details of your order, these terms and conditions, and the information on your right of withdrawal, including the model withdrawal form.

4.4 We may refuse an order if there are well-founded reasons, for example if the delivery address is outside our delivery area or there are clear indications of fraud. In that case any amount already paid is refunded without delay.

4.5 We store the contract text (your order data and these terms). You can view your order details in the order confirmation e-mail and, if you created a customer account, in your account.

5. Payment

5.1 You can pay using the payment methods shown at checkout: credit and debit cards (Visa, Mastercard, American Express and co-badged Cartes Bancaires cards), Apple Pay, Google Pay, Shop Pay, PayPal and Klarna, and also Bizum in Spain and Satispay in Italy. The methods actually available depend on your country of delivery and are shown at checkout. We do not charge any extra fee for the use of a payment method.

5.2 Payments are processed by external payment service providers. We never receive or store your full card details. For buy-now-pay-later methods the terms of the respective provider also apply.

5.3 Payment is due at the time of ordering, unless the chosen payment method provides otherwise.

6. Delivery and transfer of risk

6.1 We deliver via DPD. The estimated delivery time is 3 to 6 working days after the order confirmation, unless a different delivery time is shown on the product page. In any case, we deliver no later than 30 days after conclusion of the contract, unless we agree otherwise with you.

6.2 If we cannot deliver within the agreed period, we will inform you. You may then set an additional reasonable period for delivery; if we fail to deliver within that period, you may terminate the contract and we will refund any amount paid without undue delay. Where the agreed delivery date was essential, you may terminate immediately.

6.3 The risk of loss of or damage to the products passes to you only when you, or a third party designated by you (other than the carrier), take physical possession of the products. Damage that occurs during transport is therefore our risk.

6.4 Larger products (such as coffee tables and large mirrors) may be delivered in several parcels. More details are in our Shipping Policy.

7. Right of withdrawal

7.1 As a consumer you have a statutory right to withdraw from the contract within 14 days without giving any reason. The conditions, the effects, the online withdrawal function and the model withdrawal form are set out in our Right of Withdrawal and Returns Policy, which forms part of these terms.

7.2 In addition to the statutory right of withdrawal, we voluntarily offer a 100-day home trial: you may return products within 100 days after you received them for a full refund, under the conditions set out in that policy. This voluntary home trial does not affect your statutory rights.

7.3 Returns are free of charge for you: we bear the cost of returning the products and provide a prepaid return label.

7.4 You can withdraw easily online using the button "Withdraw from contract here", which is permanently available in the footer of every page of the Shop, in your order confirmation e-mail and in your customer account.

8. Legal guarantee (conformity)

8.1 We are liable for any lack of conformity of the products that exists at the time of delivery and becomes apparent within the legal guarantee period applicable in your country of residence (at least 2 years from delivery; in Spain and Portugal 3 years; in Ireland claims may be brought up to 6 years). Details are in our Warranty Policy.

8.2 If a product shows a lack of conformity, you are entitled to have it brought into conformity (repair or replacement) free of charge, or, under the conditions of the law, to a proportionate price reduction or termination of the contract.

8.3 Please inspect the products on delivery. If a product arrives damaged, we kindly ask you to tell us as soon as possible, preferably within 48 hours, with photos of the product and the packaging, so that we can file a claim with the carrier and help you quickly. This is a request; failing to report within 48 hours does not affect your legal rights.

8.4 In addition, we give a 10-year commercial guarantee (the "10-Year Valvelle Guarantee") on coffee tables and wall mirrors against manufacturing defects in the frame, the wood finish and the mirror silvering. Its conditions, including what is excluded and how to claim, are set out in our Warranty Policy. This guarantee is without prejudice to your legal guarantee rights.

9. Liability

9.1 We are liable in accordance with the applicable statutory provisions.

9.2 Nothing in these terms excludes or limits our liability for death or personal injury, for intent or gross negligence, under product liability law, or for any other liability that cannot be excluded or limited by law.

9.3 Please follow the assembly, mounting and safety instructions supplied with the products (see also the product safety information on each product page).

10. Complaints and dispute resolution

10.1 If you have a complaint, please contact us at info@valvelle.com. We will acknowledge receipt within 2 working days and aim to give a substantive response within 14 days.

10.2 Except as set out in clause 10.3 for consumers resident in France, we are not obliged to participate, and do not participate, in dispute resolution proceedings before a consumer arbitration board or another alternative dispute resolution body, unless the law requires us to do so.

10.3 Consumers resident in France: in accordance with Articles L.612-1 et seq. of the French Consumer Code, you have the right to refer a dispute to a consumer mediator free of charge. We are designating a consumer mediator; their name and contact details will be published in these terms and in our Legal Notice. Before referring a dispute to a mediator, please first submit your complaint to us in writing at info@valvelle.com.

10.4 For help with a cross-border dispute you can also contact the European Consumer Centre in your country (ECC-Net).

11. Applicable law and jurisdiction

11.1 These terms and all contracts concluded through the Shop are governed by Dutch law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

11.2 This choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you have your habitual residence.

11.3 You may bring proceedings against us in the courts of the country in which you are domiciled or in the Netherlands. We may only bring proceedings against you in the courts of the country in which you are domiciled.

12. Final provisions

12.1 If any provision of these terms is invalid, the remaining provisions remain in force. The invalid provision is replaced by the statutory provision that applies.

12.2 We may amend these terms for future orders. The version in force at the time of your order applies to your order.
